With this privacy policy, we clarify theuser (m/f/d)  in particular about the nature, scope and purpose of the processing of personal data (hereinafter referred to as “data”) on our websites (including our webshop), external online presence (e.B. social media profiles) and when installing and using our apps.

 

 

Our privacy policy has a modular structure. They consist of a general part for any processing of personal data and processing situations that occur when   you visit  our  website or Social  media presences, our webshop and our apps come into play (Part A: General) and a specialpart, the content of which refers only to the processing situation specified there with the name of the respective offer or product (PartB: Our websites – in particular our webshop uney.de, our apps, our social media presences).

At the end you will find information about the status and changes to the privacy policy.

Please note: You are not obliged to provide us with your personal data (even if they are partially marked with “duty” in thisdeclaration). However,   you may not be ableto use our products and services or functionalities may not be available to you or only to a limited extent if you do not provide us  with your  personal data.

2. Terms

This data protection declaration is based on the following definitions (cf.Art. 4 GDPR):

–”Personal data” (Art. 4 no. 1 GDPR) is all information relating to an identified or identifiable natural person (“data subject”).

–”Processing” (Art. 4 no. 2 GDPR) is any operation in which personal data is handled, whether with or without the help of automated (d. h. technology-supported) procedure.

–”Controller” (Art. 4 no. 7 GDPR) is the natural or legal person, entity or other body that alone or jointly with others decides on the purposes and means of processing personal data.

–”Third party” (Art. 4 no. 10 GDPR) means any natural or legal person, entity or other body other than the data subject, the controller, the processor and the persons authorized to process the personal data under the direct responsibility of the controller or processor.

–”Processor” (Art. 4 no. 8 GDPR) is a natural or legalperson,  entity or other body that processes personal data on behalf of the controller, in particular in accordance with his instructions (e.B. IT service provider). In the sense of data protection law, a processor is not a third party.

–”Consent” (Art. 4 no. 11 GDPR) of the data subject means any expression of intent voluntarily given for the particular case, in an informed and unambiguous manner, in the form of a declaration or other unambiguous confirming act by which the data subject indicates that he or she agrees to the processing of personal data concerning him or her.

3. Purpose limitation, no merging, no user profiles, transfer to third parties

Data collected by us will only be used for its specific purpose and described in this privacy policy. Processing of your personal data for purposes other than those described will only take place if a legal provision allows this or if you have consented to the changed purpose of the data processing.

In the case of further processing for purposes other than those for which the data was originally collected, we will inform you  about these other purposes before further processing and provide  you with all other relevant information.

Different data sets for different purposes are not merged by us at any time. We do not use your data for automated decision-making procedures and do not create usage profiles of our users.

We do not pass on any personal data to third parties, unless this is described in this privacy policy and necessary to achieve a legitimate purpose mentioned here, e.B. when triggering an emergency call at activated emergency call centers.

4. Legal basis for data processing

By law, any processing of personal data is prohibited in principle and only permitted if the data processing falls under a justification.

Below we indicate the legal provisions used by us. For the processing operations carried out by us, we specify the applicable legal basis in Part B.  A processing can also be based on several legal bases.

– Art. 6 para. 1 p. 1 lit. a GDPR with regard to health data, if necessary. in  conjunction with Article 9(2)(a) GDPR  (“consent”): If the data subject has voluntarily, in an informed manner and unequivocally indicated by means of a declaration or other clear confirming act that he agrees to the processing of personal data concerning him for one or more specific purposes;

– Art. 6 para. 1 p. 1 lit.b GDPR: If the processing is necessary for the performance of a contract to which the data subject is a party or for the implementation of pre-contractual measures that are carried out at the request of the data subject;

– Art. 6 para. 1 p. 1 lit.c GDPR: If the processing is necessary to fulfil a legal obligation to which the controller is subject (e.B. a statutory retention obligation);

– Art. 6 para. 1 p. 1 lit. f GDPR (“Legitimate interests”): If the processing is necessary to safeguard the legitimate (in particular legal or economic) interests of the controller or a third party, unless the conflicting interests or rights of the data subject prevail (in particular if it is a minor).

5. Data deletion and storage period

In Part B you will find information for the processing operations carried out by us, how long the data is stored with us and when it is deleted or blocked. If no express storage period is specified below, your personal data will be deleted or blocked as soon as the reason for the storage no longer applies.

However, storage may take place beyond the specified time in the event of an (impending) legal dispute with you or if the storage is provided for by legal regulations to which we are responsible.  According to legal requirements in Germany, the storage takes place in particular for 10 years in accordance with §§ 147 abs. 1 AO, 257 abs. 1 No. 1 and 4, Abs. 4 HGB (books, records, management reports, accounting documents, commercial books, for taxation of relevant documents, etc.) and 6 years according to § 257 Abs. 1 Nr. 2 and 3, Abs. 4 HGB (Commercial Letters).

When the storage period prescribed by the statutory provisions expires, the personal data will be blocked or deleted, unless further storage by us is necessary and there is a legal basis for this.

If the data are not deleted because they are necessary for other and legally permissible purposes, their processing will be restricted. This means that the data will be blocked and not processed for other purposes. This applies, for example. B, to the data that must be stored for commercial or tax reasons.

6. Cooperation with processors; in particular hosting

We use external domestic service providers to conduct our business transactions (e.B forthe areas ofIT, hosting, logistics, telecommunications, sales and marketing). These will only be valid according to our instructionsandhave been contractually obliged to comply with the data protection regulations in accordance with the requirements of Article 28 GDPR.

The hosting services used by us serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, security services and technical maintenance services that we use for the purpose of operating this online offer.

7. Storage in Germany / No transfer of personal data to third countries

Your data collected and processed by uns will only be stored on our servers in Germany. As part of our business relationships, personal data is processed exclusively within the European Economic Area (EEA). For Google Analytics, seee below at B.1.3. for social media presences and fan pages see below at B.6.

8. Legal obligation to transmit certain data

Under certain circumstances, we may be subject to a special legal or legal obligation to provide the lawfully processed personal data for third parties, in particular public bodies (Art. 6 para. 1 p. 1 lit.c GDPR).

9. Data security / ensuring services

We use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorized access by third parties, taking into account the state of the art, the implementation costs and the nature, scope, context and purpose of the processing as well as the existing risks of a data breach (including their probability and effects for the datasubject). Our security measures include e.B the use of high-performance hardware, regular updates, secure passwords and encryptions as well as backup plans and are continuously reviewed and improved in line with technological developments.

Further information on this can be obtained by you on request within the scope of what is reasonable. We cannot disclose precise information on how we and our service providers secure hardware and software in order not to take the risk   of undermining our security concepts.

10. Your rights

You can protect your rights as a data subject with regard to your processed personal data vis-à-vis us under the above under A.1. use the contact details provided at any time.

You have as the person concerned the following rights:

  • The right to information (Art. 15 GDPR),
  • The right to rectification or erasure (Art. 16, 17 GDPR),

On our website’s technologies are used to generate anonymous user statistics. Personal data will not be processed as a result of anonymization.

Our website may store the user IP for 72 hours. This is required toprotect our servers and your data from brute-force attacks and is limited exclusively to our login areas.

Contact

Our websites have contact forms. Depending on whether the request is general   or requires specific support, it will be forwarded to the responsible body at our company or one of our service providers.  

Data that we collect in our general contact form:

Integration of third-party services and content

Within our online offer, we use content or service offers from third-party providers in order to integrate their content and services, B such as videos or fonts (hereinafter uniformly referred to as “content”).

This always presupposes that the third-party providers of this content collectthe IP address ofthe users, since without the IP address they could not send the content to their browser. The IP address is therefore required for the presentation of this content. We only strive to use those contents whose respective providers use the IP address only for the delivery of the content. Third-party providers may also use so-called  pixel tags (invisible graphics, also known as “web beacons”) for statistical or marketing purposes. Legal basis of data processing

We process the data specified above on the basis of Art. 6 para. 1 p. 1 lit. f GDPR, unless otherwise stated. This is done in particular in the legitimate interest to improve the quality of our website´s and to ensure the stability and security of the   connection,  as well as for the  analysis, optimization and  economicoperation of our online offer.

The legal basis for data processing when using Google Analytics is your consent (Art. 6 para. 1 p.1 lit. a GDPR).

The processing of contact form data takes place for the processing of customer inquiries (legal basis is Art. 6 para. 1 p. 1 lit.b GDPR).

Duration of data processing

Your data will only be processed for as long as is necessary to achieve the above-mentioned processing purposes.

Third parties used by us will store your data on their system for as long as it is necessary in connection with the provision of the services for us in accordance with the respective order.

The following categories of third parties (i.e. Recipients other than processors) may have access to  your  personal data:

3. Apps HandHelp™ & HandHelp – Life Care™ & WIS Emergency

The data collected and processed when downloading the apps

When downloading our  apps, certain required data  (e.B. E-mail address, user name, customer number of the downloading account, the individual device identification number and the time of download) transmitted to the corresponding App Store (Apple App Store or Google Play).

We have no influence on the collection and processing of this data, but rather it is carried out exclusively by the App Store selected by you. Accordingly, we are not responsible for this collection and processing; the responsibility for this lies solely with the App Store of Google or Apple.

Data collected and processed during the use of the apps

Verification of the app

The first time you start the app, you will be asked to verify a mobile phone number or e-mail address via d. Information that must be entered in order to use the app is:

We collectthis information in order to protect the police or fire brigade / rescue services from false alarmmessages (Art. 6 para. 1 p. 1 lit.c GDPR  or   Art. 6 para. 1 p. 1 lit. f GDPR). In the event of a complaint from the police or fire / rescue services due to intentionally false emergency calls, we reserve the right to block the app from adevice in order to ensure a smooth running of the emergency call services.

The verification takes place via our partner CM.com Germany GmbH, who acts as our processor.

Other collection and processing when using the apps

Device information: Access data includes the IP address, device ID, device type, device-specific settings and app settings, as well as app properties, the date and time of retrieval, time zone, the amount of data transferred and the message whether the data exchange was complete, crash of the app, browser type and operating system. This access data is processed to technically enable the operation of the apps.

In particular: Use of location data

Except in the event of an alarm triggering, our apps do not collect and process any location data of the app users. In particular, this means that the apps do not use a so-called location tracker (i.e. a function that reads out location data of your smartphone permanently or at regular intervals and transmits it to the app manufacturer).

In order to be able to use the functions of the apps described in more detail below, however, in the event of an alarm triggering, processing of location data (strictly limited to the described use) is required.

To use the location data, this function must be activated in your mobile operating system. When using the apps for the first time, the permission for access to the location data is therefore requested. Your confirmation means that the apps have access to your location information in order to be able to help you with your location (emergency location) in the event of a triggered alarm.

The current location is only transmitted when the alarm is triggered. In both the Operating System of Google (Android) and Apple (iOS), you can also subsequently specify in the settings that our apps may no longer receive information about your location. In this case, however, the apps only work to a very limited extent, because in order to be able to send a meaningful alarm message (e.B. to your trusted person), access to the location data is necessary.

Personal and health information in the apps HandHelp / HandHelp – Life Care / WIS Emergency

In order to be able to provide fast and effective help, we give users the opportunity to voluntarily store further information in the app. The following data are listed, which are transmitted voluntarily (referred to as voluntary below) and which are mandatory (referred to as mandatory below):

This information remains stored on the end device (smartphone / tablet / wearable) as long as no emergency call or test alarm is executed and can be protected from third parties by entering a password. Only in the case of an emergency call / test alarm will this information be transmitted to his stored and activated helper network as desired by the user.

Each app is delivered without activated emergency call centers and without trusted persons. By selecting the emergency call centres and selecting his confidants, the user expressly agrees that information that he has stored in the app and information resulting from the emergency call will be forwarded to the police or fire brigade / rescue services and abroad to embassies (foreign representations) and his confidants.

The information is transmitted individually according to the wishes of the user.

As a rule, we collect and process data via the apps, which is necessary for the performance of the contract between you and us (Art. 6 para. 1 lit.b GDPR),unless a specific legal basis is mentioned above.

Furthermore, we collect and process this data if this is necessary for the functionality of the app (Art. 6 para. 1 lit. f GDPR).

We process your voluntarily deposited health data on the basis of your consent (Art. 6 para. 1 p. 1 lit. a GDPR in conjunction with Art. 9 para. 2 lit.a GDPR).

Cancellation / transmission / storage / deletion periods

An emergency call or a test alarm, if it is executed in the app, can be canceled within a visible countdown by clicking on the HELP! button. If the emergency call is aborted, no data is transmitted. Inthe event that the user uses the Bluetooth emergency button (uney button), a  transmission can no longer be canceled after it has been started. In the event of an accidentally triggered emergency call, the user should immediately inform the police or fire / rescue services of this.

The data transmitted to us will not be further analyzed, sold or reused by us in any way. They serve the sole purpose of rapid and effective assistance from the competent authorities.

If we do not receive a request to keep this data, your data will be automatically deleted as follows:

Data from test emergency calls – 14 days

Data from emergency calls – 90 days

All emergency call details are located under an individually generated link with password protection on a secure server of snafu Gesellschaft für interaktive Netzwerke mbH. The servers are software and hardware side protected according to the latest state of the art against unauthorized access.

4. Social Media-Presences / Fanpages

We maintain publicly accessible profiles and fan pages in various social networks. Your visit to these profiles sets in motion a variety of data processing operations. Below we give you an overview of which of your personal data is collected, used and stored by us when you visit our profiles.

When you visit our profiles, your personal data is collected, used and stored not only by us, but also by the operators of the respective social network. This also happens if  you  do not have a profile in the respective social network. The individual data processing operations and their scope differ depending on the operator of the respective social network and they are not necessarily comprehensible to us.

No social media plugins

On our websites, we do not use so-called social media plugins (such as like buttons).

If our websites contain symbols of social media providers (e.g. Facebook, Twitter, Instagram), we only use them for passive linking to the pages of the respective providers.

Profile / Fanpages

We currently operate fan pages and channels on Facebook, Twitter, Instagram and YouTube. Each time you access these pages, various data are incurred,.B such as with which IP address or at what time  du accesses these pages. We only get anonymised statistical data or possibly information about “liked” content and comments / retweets and the resulting data.

We would like to point out that posted posts are generally available from other users.   We therefore recommend the use of pseudonyms, so that the contributions can not be directly assigned to a person.

The data processing by us serves our legitimate interest, the user experience when visiting our social media profiles or. To improve fan pages in a target group-oriented manner (Art. 6  para. 1  lit. f) GDPR.

If you use our profiles in social networks to contact us (e.g. by sending us messages), your data provided to us will be processed exclusively for the purpose of being able to contact you (Art. 6 para. 1 lit. a and b GDPR).
